6. Allergen and Dietary Information Disclaimer

Cafe Rio makes reasonable efforts to provide accurate allergen and nutritional information for its menu items. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CAFE RIO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, OUR SERVICES, EVEN IF CAFE RIO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, CAFE RIO'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO CAFE RIO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. In such cases, our liability will be limited to the greatest extent permitted by applicable law.

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our gross negligence, fraud, willful misconduct, or any other liability that cannot be excluded or limited by applicable law.

8. Disclaimers and "As-Is" Basis

These Terms are subject to applicable federal laws, including but not limited to:

  • The Federal Trade Commission Act (15 U.S.C. § 41 et seq.) governing unfair or deceptive trade practices.
  • The Computer Fraud and Abuse Act (18 U.S.C. § 1030) regarding unauthorized computer access.

11. Dispute Resolution

11.1 Informal Resolution

We will attempt to resolve the dispute informally within thirty (30) calendar days of receiving your notice. If we are unable to resolve the dispute informally within this period, either party may proceed with formal dispute resolution as described below.

11.2 Binding Arbitration

EXCEPT FOR CLAIMS THAT MAY BE BROUGHT IN SMALL CLAIMS COURT OR CLAIMS SEEKING INJUNCTIVE RELIEF TO PROTECT INTELLECTUAL PROPERTY RIGHTS, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION, OR VALIDITY THEREOF, OR YOUR USE OF OUR SERVICES, SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) UNDER ITS CONSUMER ARBITRATION RULES, WHICH ARE AVAILABLE AT WWW.ADR.ORG.

The arbitration shall be conducted in English, in the applicable United States jurisdiction, or by telephone or video conference if agreed upon by both parties. The arbitrator shall have the authority to grant any remedy that a court of competent jurisdiction could order or grant, subject to the limitations set forth in these Terms. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

11.3 Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND CAFE RIO AGREE THAT EACH PARTY MAY ONLY BRING CLAIMS AGAINST THE OTHER IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

11.4 Jury Trial Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND CAFE RIO WAIVE YOUR RESPECTIVE RIGHTS TO A JURY TRIAL IN CONNECTION WITH ANY DISPUTE ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES.

12. Term and Termination
